The focal point of David Goodman's legal practice is strategic risk management. He is a commercial litigator who applies the knowledge gained through years of experience in aggressive litigation to working with clients to manage and control the risks associated with their businesses. David's approach is to design and implement strategies to avoid litigation and to facilitate aggressive and pragmatic dispute resolution in the event that litigation is unavoidable.

David's concentration is primarily in the areas of business litigation, insurance coverage litigation, trade secret litigation, employment counseling and litigation, and tort defense. David's clients range from large closely held corporations to small businesses, and include manufacturers, professional service providers, real estate developers, professional employer organizations, and contractors. David has extensive first-chair trial experience, and regularly represents clients in federal and state courts, including appellate courts, in jurisdictions throughout the country. In addition to his work in the courtroom, he routinely represents clients in arbitrations and mediations.

As a business litigator, David assists clients to secure the rights and benefits for which they contracted. For example, he regularly litigates against insurance carriers to help clients enforce their rights under insurance policies ensuring they receive the coverage for which they paid. He advises clients on collection strategies and works with them to implement those strategies to maximize the return. He has extensive experience with disputes arising from employee dishonesty and breaches of fiduciary duties owed by officers and directors. He also provides broad employment-related counseling and litigation services involving employment disputes, employment contracts, severance agreements, EEOC investigations and claims, OSHA compliance, internal investigations, and leave issues. David has extensive experience litigating trade secret and other intellectual property disputes involving trade secret misappropriation, the Lanham Act, and unfair trade practices.

David regularly represents clients involved in commercial disputes with extensive experience litigating and arbitration insurance coverage and toxic tort claims; recent matters have included insurance coverage litigation, fraud and consumer fraud, shareholder disputes, professional negligence, product liability and construction negligence, personal injury, wrongful death, among other areas.

PROFESSIONAL ACTIVITIES
Drawing on his years of experience as a litigator and business counselor, David is a regular speaker at legal and industry seminars, where he has addressed professionals from a variety of industries including human resources on topics such as record retention and the development and enforcement of effective record retention programs, restrictive covenants, how to conduct internal investigations, FLSA regulations and FMLA compliance.

He is committed to the development of new legal professionals, having served as the chair of the litigation department of a mid-sized Chicago law firm, managed summer associate programs for law students and serving on various associate-development and continuing legal education committees throughout his career.

David is a member of the Chicago, Illinois State and American Bar Associations.
