Litigation and Dispute Resolution
Joseph L. Cohen concentrates his practice in areas of commercial and real estate litigation (including mechanics liens) as well as title insurance defense work. He additionally represents clients in a range of commercial litigation matters involving breach of fiduciary duty, bankruptcy, contracts, commercial paper, toxic tort, and credit reporting.
He has written numerous memoranda on a broad spectrum of subjects, including core proceedings in bankruptcy, enforceability of negotiable instruments, bank fraud, corporate indemnification agreements, fiduciary duty, securities class actions, and Gramm-Leach-Bliley Act Notice requirements.
As a litigator, Joe has represented clients as first or second chair in jury as well as bench trials in both federal and state courts. As lead attorney, he has defended a lending institution in credit reporting disputes; he has also worked on legal teams in federal criminal sentencing hearings, argued on behalf of trustees in bankruptcy hearings and participated in plea negotiations on behalf of white-collar criminal defendants.
His responsibilities have included: arguing contested motions, evidentiary hearings, and representing clients in mediation; drafting appellate briefs, dispositive motions, and pleadings; and conducting all facets of both written and oral discovery.
IN THE PROFESSION
While in law school, Joe served as an extern for the Honorable Elaine Bucklo, Federal District Court Judge for the Northern District of Illinois.
