Business Bankruptcy, Bankruptcy Litigation, Creditors' Rights and Insolvency, and Commercial Litigation
Mr. Radtke concentrates his practice in corporate reorganization, creditors’ rights, bankruptcy and commercial litigation involving contract disputes, the Uniform Commercial Code, lien rights, employment issues, fraud, fiduciary duties and corporate governance. Mr. Radtke has represented debtors, trustees, assignees, committees, financial institutions, secured and unsecured creditors, interest holders, and both business entities and individuals in a variety of insolvency and commercial matters. Mr. Radtke has developed distressed debt workout strategies for debtors and creditors; assisted
clients with asset sales; developed and implemented plans of reorganization; and litigated contested matters in state and
federal courts, including appellate practice before the Court of Appeals for the Seventh Circuit.
Illustrating his recent experience, Mr. Radtke represents the official committee of unsecured creditors and an ad hoc
group of secured trade creditors in separate residential home builder cases, individual and corporate debtors in their joint
efforts to reorganize their businesses into a public company and a Mexican foreign exchange in a cross-border insolvency
case. Mr. Radtke has also represented Florsheim Group Inc. resulting in the confirmation of its joint chapter 11 plan and
the establishment of a liquidating trust; assisted in the recovery of $18 million in fraudulent transfers; represented an
equity committee in a chapter 11 case in which the equity holders obtained a recovery in excess of $16 million; and
successfully defended an assignee for the benefit of creditors in a federal jury trial involving a multi-million dollar breach of
contract claim. Additionally, he represents a large publicly-traded company in various in-court and out-of-court bankruptcy
and insolvency matters nationwide.
Mr. Radtke was an Executive Articles Editor for the Chicago-Kent Law Review. He was also elected to the Order of the
Coif, a national honor society for scholastic achievement in law. In 2008, he was selected as an "Illinois Rising Star" by
Law & Politics publishing for the February 2008 issue of Chicago Magazine.
