Terence G. Banich has represented and counseled a wide variety of clients regarding the prosecution and defense of varied sorts of civil cases, as well as litigation avoidance. He has represented, for example, publication, pharmaceutical, energy, chemical and candy companies, regional and national banks, a major defense contractor, individual executives, as well as elected public officials in everything from routine business litigation to cases involving multi-state/federal district class-actions, foreign-judgment domestication and enforcement, False Claims Act qui tam claims, statutory interpleader, criminal and civil racketeering, grand jury investigations and a federal criminal trials.
Mr. Banich also has developed an expertise in construction litigation and counseling, including representing owners, contractors, subcontractors, material suppliers and architects/engineers in mechanics lien, surety bond and contract disputes. He has lectured on the subjects of common construction disputes, litigation of construction claims, mechanics liens, and suretyship issues. Mr. Banich also has extensive experience representing parties-in-interest – such as debtors in possession, secured and unsecured creditors and chapter 7 trustees – in bankruptcy litigation, including adversary proceedings and contested matters. He has represented a court-appointed independent fiduciary/equity receiver in carrying out his duties pursuant to a creditor-repayment plan arising out of a Securities and Exchange Commission enforcement action.
Mr. Banich has published articles in the Bloomberg Corporate Law Journal, the Real Estate Finance Journal and the Banking Law Journal.
During law school, Mr. Banich was a member of the Loyola University Chicago School of Law’s law review, the Law Journal. He also served as a judicial law clerk in the Circuit Court of Cook County, Illinois for the Honorable Richard E. Neville (Law Division, 1998 to 1999), and to the Honorable Thomas R. Fitzgerald (Criminal Division, 1997 to 1998).
In 2008, Loyola University Chicago appointed Mr. Banich an Adjunct Professor of Law in its School of Law, where he teaches a course on advanced civil litigation. Before joining Shaw Gussis, Mr. Banich was a Partner at Jenner & Block LLP.
