The Real Estate Practice at Shaw Gussis offers more than three decades of experience in all aspects of commercial and residential ownership and development, including acquisitions, zoning and entitlements, financing, leasing, economic incentives, and sales. We have assisted with projects consisting of a single building to sophisticated, mixed use developments encompassing hundreds of acres. Our clients range from small entrepreneurs to large corporate entities, all of which are seeking and receiving experienced, personalized legal services at competitive rates.


Each of the Real Estate attorneys at Shaw Gussis has previously practiced in a large firm environment, affording exposure to highly sophisticated transactions. That experience coupled with the individualized attention of our boutique practice, creates responsive and effective representation.


Acquisitions and Sale – We regularly assist clients in the renegotiation, structuring, conducting due diligence, and closing of real estate transactions.


Leasing – Our commercial, office and industrial leasing experience includes both landlord and tenant representation from small, single use spaces, to leasing counsel for commercial centers in excess of 600,000 square feet.


Zoning and Land Use – We represent owners and developers with respect to the securing of entitlements, general problem analysis, and resolution of land use issues. In these areas, our clients vary from individuals, to large, national retailers and service providers.


Financing – Our attorneys represent developers and owners in the negotiation and documentation of all aspects of real estate financing. We also represent institutional lenders with respect to their secured real estate lending business.


Development Documentation – Our attorneys have negotiated and drafted complex Declarations, Reciprocal Easement Agreements, and Operating Easement Agreements in conjunction with the development of commercial projects, as well as supporting documentation for residential Planned Developments and condominium projects.


Loan Workouts and Restructuring – In conjunction with the Shaw Gussis Commercial Bankruptcy and Restructuring Group, our Real Estate attorneys have worked with both creditors and debtors with respect to the work-out and restructuring of secured real estate loans. We have also served as real estate counsel to bankruptcy trustees and asset assignees.


Commercial Lease Evictions – In conjunction with the Shaw Gussis Litigation Group, our Real Estate attorneys handle retail, office and industrial evictions on behalf of both landlords and tenants.
