Guiding his clients through their complex legal issues in the hope of avoiding litigation or to aggressively protect their interests when litigation is unavoidable, is the core of David Goodman’s practice. Through the design and implementation of litigation avoidance strategies David’s approach is to manage and control the risks specific to their businesses, whether they are entrepreneurs or large corporations. When litigation is unavoidable, David, an experienced, commercial litigator, facilitates an aggressive and pragmatic resolution.

David concentrates primarily in the areas of business litigation, insurance coverage litigation, unfair competition and trade secret litigation, tort defense, and employment counseling and litigation. David’s clients range from large, closely held corporations to small businesses. His clients include manufacturers, professional service providers, real estate developers, professional employer organizations and contractors. An experienced, first-chair trial lawyer, David represents his clients in federal, state and appellate courts throughout the country as well as in arbitrations and mediations. Examples of this experience include:

  • Litigating against insurance carriers to ensure his clients receive the coverage for which they paid.
  • Representing employers in disputes arising from employee dishonesty and breaches of fiduciary duties by
    officers and directors.
  • Litigation involving trade secret misappropriation and unfair trade practices.

In addition to his litigation experience, David also provides broad employment-related counseling services involving employment disputes, employment contracts, severance agreements, EEOC investigations and claims, and internal investigations. He regularly represents clients through both litigation and arbitration, in commercial disputes involving insurance coverage and toxic tort claims. Recently, he has been involved in matters including environmental litigation, fraud and consumer fraud, shareholder disputes, professional negligence. He has argued appeals in state and federal appellate courts including before the Illinois Supreme Court and the Seventh Circuit Court of Appeals.

A frequent speaker, David has addressed professionals representing industries on a wide range of topics. Topics in the human resources area include: the development and enforcement of effective record retention programs, restrictive covenants, conducting internal investigations, and FLSA and FMLA regulations and compliance.

Committed to the development of new legal professionals, David has served as the chair of the litigation department of a mid-sized Chicago law firm, managed summer associate programs for law students, and has served on several associate development and continuing legal education committees throughout his career. David has been given an AV rating by Martindale Hubbell, and is a member of the Chicago, Illinois State and American Bar Associations.
