David Horwitch employs a fresh, business-oriented approach to his clients’ real estate transactions. From shopping centers and restaurants to apartment and office buildings, David has represented all of the players in real estate transactions including owners, developers, landlords, tenants, borrowers and lenders.

His experience spans a broad range of properties including: shopping centers, office buildings, industrial properties, mixed-use developments, apartment buildings, condominiums, houses, and vacant land. He represents these parties in the context of acquisitions and dispositions, contract negotiations and disputes, structuring and negotiating complex transactions, financing, land development, zoning, leasing, and other matters.

David’s practice also includes working with borrowers and lenders to solve their real estate problems. An experienced litigator, David works with his clients to resolve their disputes both in and outside of the courtroom. Examples of his dispute resolution experience include:

  • Disputes and evictions involving national shopping center tenants and owners
  • Foreclosure and loan issues of distressed properties for both lenders and borrowers
  • Disputes among residential homeowners
  • Construction-related disputes
  • Entitlement and land-use issues for developers

The founder and first President of the pre-law chapter of Phi Alpha Delta Law Fraternity at the University of Illinois, David subsequently served as the President while attending the University of Illinois College f Law. While in law school, David also taught an undergraduate course on the principles of effective public speaking. Recently, he addressed a group of lawyers on loan workouts and short sales.

David is a member of the Illinois State Bar Association and its real estate section. Prior to joining Shaw Gussis, David was a partner with the Chicago firm of Arnstein & Lehr LLP.
